RE: The tariff classification of titanium sheet from Japan.

Dear Mr. Furuse:

In your letter dated May 12, 2003, you requested a tariff classification ruling.

You have described your item as titanium sheet with a thickness of 0.025” or 0.035” and having a width of 12.625”. The sheet is supplied in coils, rolled down to thinner thickness and surface treatments are applied (chemical, cleaning, heat treatment, etc.). Such processed titanium sheets are used in various industrial fields where high/corrosion resistance and lightweight properties are required.

The applicable subheading for the titanium sheet will be 8108.90.6045, Harmonized Tariff Schedule of the United States (HTS), which provides for titanium and articles thereof, including waste and scrap: other: other: plates, sheets, strips and foil. The rate of duty will be 15% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
